SuperScaled ("SuperScaled", "we", or "us") offers an AI agent-based recruiter SaaS platform to discover and engage with job candidates.

SuperScaled respects your privacy. This Privacy Policy ("Policy") explains how SuperScaled collects, uses, and discloses personal information obtained through our website ("Site"), as well as information that we collect and process from or about job candidates as part of offering you our services (collectively, with the Site, the "Services"). By using our Services, you are agreeing to the terms of this Policy.

This Privacy Policy does not apply to personal information that we process on behalf of our customers, such as information pertaining to our customers' authorized users of our services. We process this information as instructed by our customers, in our capacity as a service provider/data processor, in accordance with the terms of our customer agreements.

Our Use of AI-Powered Services

SuperScaled uses AI-powered agents and machine learning models to provide an effective way for customers who purchase our products and services to acquire, engage, and retain talent. Specifically, customers can use our AI agents to put together search strategies for job applicants who meet certain criteria, conduct deep research on candidates, and generate personalized messages to applicants of interest.

We may use third-party providers such as OpenAI to power parts of our AI agents, but we do not allow these providers to train their AI models using your data and we require these providers to delete your data within 30 days unless otherwise required by law.

As a customer of SuperScaled, you may opt out of using any AI models. To do so, contact your account manager or support at contact@superscaled.com.

Personal Information We Collect and Sources of Information

Public Information We Collect About Job Candidates

If you have a profile, resume, or CV on a publicly-available website, we may collect public information about your professional qualifications and contact information to provide to our customers.

The information we collect about you may include personal information such as your first and last name, education, professional or employment-related qualifications (years of experience, publications, skills, etc.), work history, work title, contact information (e.g. phone number and email address), and other employment-related experience.

The information collected about job candidates is used by our customers to discover and engage with candidates. We do not collect sensitive data (e.g., health or political affiliation) from any of these public sources.

We may infer other characteristics about job candidates based on the information provided on their profiles.

Other Information We Collect About Job Candidates

Our customers may also create custom job candidate profiles from personal information they maintain regarding job candidates. In this situation, SuperScaled is acting as a processor of the personal information associated with the profile, and only processes this information on behalf of that customer. This job candidate profile information is not available to other customers using SuperScaled's AI agent search engine.

Information We Collect From Website Visitors

When you make a request to receive information about our services, book a demo, contact our sales team or customer support team, or sign up for a SuperScaled account, you provide us with certain information, such as:

  • Business contact details, including your first and last name and email address
  • Account information, such as your account credentials, billing information, payment information and other information used to administer your account, including the services you have purchased or may be interested in
  • Communications that we exchange with you, including when you contact us with questions, feedback, or otherwise
  • Marketing information, such as your preferences for receiving communications about our services and publications, and details about how you engage with our communications
  • Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection

Social Media Information

We may maintain pages on social media platforms. When you visit or interact with our pages on those platforms, you or the platforms may provide us with information about you.

Information We May Collect From Other Sources

We may obtain personal information about business customers or job applicants from third parties, such as marketing partners and data providers, to update, expand, and analyze our records, identify new prospects for sourcing, and provide information or job vacancies that may be of interest to our customers.

Automatic Data Collection

When you use the Site, we and our service providers may automatically log information from your computer (or other device) and your browser about you, your computer or mobile device, and your interaction over time with our services, such as:

  • Device data, such as your computer's or mobile device's operating system, manufacturer and model, browser type, IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state or geographic area
  • Usage data, such as pages or screens you viewed, how long you spent on a page, browsing history, and access times

How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our AI agent-based recruiting services
  • Process transactions and manage your account
  • Enable our AI agents to search, evaluate, and match candidates

  • Detect, prevent, and address technical issues and security threats
  • Comply with legal obligations and enforce our terms of service
  • Send you marketing communications (with your consent)
  • Train and improve our AI models using anonymized, de-identified, or PII-stripped data

AI Model Training and Data Usage

As an AI agent-based recruiter SaaS platform, SuperScaled uses machine learning and artificial intelligence to power our recruiting services. To continuously improve our AI models and algorithms, we may use anonymized, de-identified, or PII-stripped user data for model training purposes.

When we use data for model training:

  • All personally identifiable information (PII) is removed, anonymized, or de-identified before use
  • We use industry-standard techniques to ensure data cannot be traced back to individual users
  • This practice helps us improve the accuracy, efficiency, and effectiveness of our AI recruiting agents
  • Model training data may include anonymized usage patterns, interaction data, and other non-identifying information

By using our Service, you consent to this use of anonymized data for AI model training and improvement purposes.

Analytics and Tracking Technologies

We use various analytics and tracking tools to understand how users interact with our platform, measure performance, and improve our services. These tools may collect information about your use of the Service, including:

  • Google Analytics: We use Google Analytics to analyze website traffic, user behavior, and platform usage. Ownership of Customer Data

As between you and SuperScaled, you own all right, title, and interest in and to your Customer Data. "Customer Data" means any data or content that you submit, post, or display through the Service, including job postings, candidate information, and any other information you provide to SuperScaled. We do not claim ownership of your Customer Data. However, by using our Service, you grant SuperScaled a license to use your Customer Data as described in our Terms of Service, including for the purpose of providing and improving our services and for AI model training with anonymized data.

Information Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: With trusted third-party vendors who assist in operating our platform, processing payments, and providing analytics (including Google Analytics and Meta Pixel)
  • Business Transfers: In connection with a merger, acquisition, or sale of assets
  • Legal Requirements: When required by law, court order, or government regulation
  • Protection of Rights: To protect the rights, property, or safety of SuperScaled, our users, or others
  • With Your Consent: When you explicitly authorize us to share your information

Data Security

California Privacy Rights (CCPA)

If we maintain personal information about you that is subject to the California Consumer Privacy Act ("CCPA"), you may exercise certain rights in connection with this data if you are a California resident.

Right to Know

California residents have the right to request that we disclose certain information about our collection and use of your personal information over the past twelve months ("Right to Know"). Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • The categories of personal information that we have disclosed for a business or commercial purpose
  • Our business or commercial purposes for collecting, selling, or sharing personal information
  • The categories of third parties with whom we share or disclose that personal information
  • The specific pieces of personal information we collected about you (i.e., a data portability request)

Right to Delete

California residents have the right to request that we delete the personal information that we collected from you and retain, subject to certain exceptions ("Right to Delete"). Once we receive and verify your request, we will delete (and direct our service providers/contractors to delete) your personal information from our records, unless an exception applies.

Right to Correct

California residents have the right to correct or amend the personal information we have on file ("Right to Correct"). You may correct or amend by logging into your account or by contacting us using the information below.

Right to Opt-Out of Sale or Sharing

The CCPA provides California residents with the right to opt-out of the "sale" or "sharing" of their personal information ("Right to Opt Out"). If you wish to opt-out of the sale or sharing of your personal information, please write to us as provided in the Contact Us section below.

We do not have actual knowledge that we sell or share the personal information of California residents under the age of 16.

Right to Limit the Use of Your Sensitive Personal Information

The CCPA provides California residents with the right to limit the use of their "sensitive personal information" to the purposes outlined in Cal. Code Regs. tit. 11, § 7027(m) of the CCPA regulations. We do not collect your sensitive personal information.

Right to Nondiscrimination

The CCPA provides California residents with the right not to receive discriminatory treatment for the exercise of their privacy rights conferred by the CCPA. We will not discriminate against you for exercising any of your CCPA rights.

Exercising Your Rights

If you are a California resident and wish to exercise any of the above rights, you may write to us as provided in the Contact Us section below.

When you submit a request, we will confirm your identity by asking you to provide information associated with what we have on file for you, including your name, email address, and other identifying information. We may ask you for additional information to verify your identity or to comply with your request.

Authorized Agent: You may authorize an agent to make a request on your behalf. To designate an agent, please provide a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. We will still require you to provide information to allow us to reasonably verify that you are the person about whom we collected personal information.

Shine the Light Law

In addition to the CCPA, California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. Alternately, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties' direct marketing purposes if the customer has exercised an option to opt out of such information sharing. We have such a policy. As discussed above, if you want to opt out of any sharing of your information, please contact us using the information below.

Data Retention

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfil the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws and regulatory obligations or until you withdraw your consent (where applicable). When we destroy your personal information, we do so in a way that prevents that information from being restored or reconstructed.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.

International Data Transfers

Your information may be transferred to and processed in countries other than your own. We ensure that appropriate safeguards are in place to protect your information in accordance with this Privacy Policy and applicable data protection laws.

Children's Privacy

Our services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us immediately.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated policy.
